BOX 109-152 Westway (Field E), 1871-1994
Litigation files and background material relating to the proposed West Side Interstate Highway (later named “Westway”) in Manhattan. Hoppen filed a lawsuit against the West Side Highway Project on behalf of Action for Rational Transit (ART) in 1974. This lawsuit centered on the project’s impact on air quality and on violations of the Clean Air Act, the National Environmental Policy Act (NEPA), and other federal regulations. Judge Thomas P. Griesa of the U.S. District Court for the Southern District of New York ruled that the plaintiff(s) did not sufficiently demonstrate Westway’s air quality impact and the case was dismissed, a judgement upheld by the U.S. Court of Appeals in 1982. The subseries also contains material related to subsequent legal action, including a case filed by the Sierra Club against the U.S. Army Corps of Engineers which successfully argued that the proposed highway would negatively impact the Hudson River’s fish population. Litigation files for these cases include affidavits, complaints, exhibits, interrogatories, transcripts, correspondence, and legal research. An alphabetical file which comprises more than half of the subseries contains correspondence, news clippings, newsletters, notes, pamphlets, research, reports, and other printed matter related to events, topics, and other organizations involved in or relevant to the fight against Westway.
Arranged according to an inventory created by Hoppen. Litigation files are filed at the beginning of the subseries followed by an alphabetical file organized by name, organization, legal case name, topic, or type of material. Files relating to the lawsuit brought by the Sierra Club v. U.S. Army Corps of Engineers follow the alphabetical file. Miscellaneous articles and other material are filed at the end of the subseries. Newspaper clippings from this latter group were infected with mold and not retained.
