Files relating to a successful lawsuit filed by Hoppen in federal court in 1973 on behalf of the Harlem Valley Transportation Association against the Interstate Commerce Commission (ICC). The lawsuit requested declaratory and injunctive relief from the commission’s alleged violation of the National Environmental Policy Act of 1969. The act required the ICC to prepare impact statements before holding hearings in railroad abandonment proceedings if it was determined that federal actions would significantly affect the human environment. Joined by the Natural Resources Defense Council and other plaintiffs, the Harlem Valley Transportation Association argued that ICC had not conducted impact studies despite the fact that the abandonment of Northeast rail lines under a reorganization of the Penn Central Transportation Company would result in increased noise, traffic congestion, and air pollution as a result of increased truck traffic. The judge granted a preliminary injunction, a decision that was upheld in an appeal filed by the ICC. Case files include complaints, memoranda, briefs, affidavits, and exhibits.

An alphabetical file and a section on other related matters contain correspondence, memoranda, reports, legal research, legal records from other lawsuits, newsletters and organizational mailings, press releases, maps, and news clippings. Much of the background research relates to the abandonment of rail lines. Also included in the subseries is correspondence, newsletters, and writings by Lettie Gay Carson, a transportation and environmental activist who served as president of the Harlem Valley Transportation Association.
Arranged according to an inventory created by Hoppen. Files from the U.S. District Court and U.S. Court of Appeals cases are filed at the beginning of the subseries. An alphabetical file and a section on other related matters follow. Each is organized alphabetically by name, organization, legal case name, topic, or type of material.
